Outcome:

The court ordered that the Wife should have occupation of the property for an interim period up to the point the house is sold, or the Husband buys out her beneficial interest, but it is not a long-term solution.

INTERESTING POINTS – The court found that the Wife was not at risk of significant harm, but when applying their discretion, found that the Husband had better financial resources to rehouse himself in the interim as opposed to the Wife. The court urged that the Wife must be proactive in finding alternative accommodation to prevent the Husband being excluded from his home any longer.
