Defending in a claim for over 60 parking fines, where only one was set out in the Claim Form, but the Claimant intended to relitigate for the remaining fines

Acting for: Defendant
Court: Medway Family Court

Outcome:

The Defendant was ordered to pay the one parking fine that the Claimant sought to recover on the Claim Form and Particulars of Claim.

INTERESTING POINTS – There are over 60 parking fines against the Defendant which the Claimant subsequently sought to recover, despite not setting them out in the Claim Form or Particulars of Claim, or at any point prior to the trial. Emma made submissions that these should have been brought at first instance, given the fines were accumulated prior to the claim being commenced and any attempt at relitigation should be considered an abuse of process.
