From Family Procedure Rules to Civil Procedure Rules under the Inheritance Act

John’s client, the Claimant, was in the process of negotiating a matrimonial finance settlement with her ex-husband, when the ex-husband died.

This meant a complete change of applicable law, going from the Family Procedure Rules to the Civil Procedure Rules.

The client was unsure whether or not she could/should issue proceedings in court, and if so, how to go about doing it.

John’s expertise in both family finance and contested probate law were of great assistance to his client in this case. He was heavily involved in preparing new statements of case to be dealt with in the civil (rather than family) court, and ensuring all relevant points of law and procedure were properly dealt with. John’s client’s application was successfully issued at court.
