Opposing a Lives With Order application at an FHDRA

Acting for: Respondent Mother
Court: Canterbury Family Court

Outcome:

The father, who had not seen the children in a year, sought an order for the children to live with him on the day of the first hearing, despite there being no section 7 report and a number of allegations made against him.

The application was opposed on the basis that it would be unsafe to make such order without Cafcass conducting a s7 report and that contact should be reintroduced gradually. It was ordered that contact with the father will be supervised up to the point of the next hearing and the children shall remain living with the mother for now.
