Outcome:

Despite the Applicant not attending due to childcare issues and the Respondent not turning up, Emma successfully obtained a Non-Molestation Order for the Applicant. The court was not minded in the first instance to make the order. Emma was able to persuade the court that it was necessary to make the order due to the detrimental effect of a delay.

INTERESTING POINTS – Despite the Respondent being served with just under two days’ notice of the hearing, it was determined that this was sufficient notice.
